1. Biometric & Privacy Consent

I confirm that I am legally responsible for obtaining explicit, informed consent from all event attendees to capture their likeness and process their biometric data (facial recognition) through this platform. The Platform acts solely as a data processor.

2. Sole Responsibility for Distribution

I am solely responsible for who receives access to the event galleries. The Platform is not liable for unauthorized sharing, leaks, or privacy breaches resulting from gallery links distributed by me or my clients.

3. Temporary Storage & No Backups

I understand that this Platform is a temporary distribution service, not a cloud backup solution. All uploaded files, including high-resolution images, thumbnails, and facial recognition data, will be permanently and irreversibly deleted 60 hours after the event concludes.

4. Dispute Resolution

I agree that any requests from event attendees to remove, delete, or alter their images must be handled directly by me. The Platform will not mediate disputes between me and the event attendees.

5. License to Process

I retain full copyright of all uploaded images. However, I grant the Platform a temporary, limited license to host, compress, create thumbnails, and apply machine learning algorithms to these images solely to provide this service.

6. Prohibited Content

I agree that I will not use this software to upload, process, or distribute illegal content, non-consensual intimate imagery, or any material that violates local, state, or federal laws.

7. Software Licensing Restrictions

I agree that the desktop application is licensed to me for personal/business use only. I will not reverse-engineer, decompile, attempt to extract underlying machine learning models, or distribute the executable software to unauthorized third parties.

8. Total Indemnification

I agree to indemnify, defend, and hold the Platform harmless against any legal claims, damages, or lawsuits brought by third parties (including event guests or venues) resulting from my failure to obtain consent, copyright infringement, or misuse of this service.

9. Updates to Terms

I agree that the Platform may update these terms at any time. I will be notified of any changes and must accept the updated terms to continue using the service. Continued use of the service will be considered as acceptance of the updated terms.
